Terms of Use

ASISAMA (hereinafter referred to as the “ Store ”) hereby provides the User terms and conditions (hereinafter referred to as the “ Policy ”) in using the website 'asisama.com' (hereinafter referred to as the “ Site ”), which is an online retail store operates as follows:

CHAPTER 1 - GENERAL PROVISIONS

Article 1 - Scope of Policy

This policy regulates the relationship between the Store and its customers who use the Site in terms of using shopping services and other related services (hereinafter collectively referred to as " Services ") on the Site where the Store operates.

“ Account ” means the User's transaction account which is opened by the method determined by the Store in order for the Store to provide Services to the User after the User agrees to the Policy.

“ Personal Data ” means any Data Applicant/Service User either identified and/or can be identified separately or in combination with other information either directly or indirectly.

“ Applicable Law” means laws, rules, regulations, customs, uses, practices, decisions, interpretations, directives, directions, decisions, guidelines, notices, practice notes and circulars from all the competent Regulatory Bodies for the time being in force and binding on related parties or use or offering of the Service.

“ Content ” means digital online information or materials provided by the Store or third parties to Users in the form of signs, letters, diagrams, colors, sounds, sounds, images, videos (or in any combination of the foregoing).

“ Intellectual Property Rights” means copyright, patent, utility model right, trademark right, design right or other intellectual property right (including the right to obtain such rights or to apply for registration, and other similar rights);

“ Loss ” means all losses, liabilities, costs (including legal fees), charges, expenses, actions, proceedings, claims and demands;

“ Applicant ” means a person or legal entity who aims to become a Service User on the Site by registering his/her Personal Data on the Site.

User " means a person or legal entity who has successfully registered to have an account on the Store's Site and has the right to use the facilities of the Service on the Site.

Article 2 - Agreements and Modifications

  1. The Applicant/User warrants, undertakes, and is deemed to have read and agreed to the Policy governing the terms and conditions of offering or using the Service. The policy applies to the Applicant/User at any time the submission of information for the purpose of creating a Membership Account according to the procedures set out on the Site.
  2. The Store reserves the right to make changes to the Policy at any time, subject to Applicable Law. The Store will notify Users of changes made to the Policy, by postinga notice on or through the Site or in accordance with the method determined by the Store reasonably. In giving notification to Users, the Store will state the effective date of the changes to the revised Policy and will be uploaded on/through the Service (“ Changes Effective Date ”).
  3. If the User does not agree with the changes made by the Store to the Policy, the User has the right to terminate the Service according to the method provided on the Site. Use of the Service after the Change Effective Date constitutes the User's consent to be bound by the Policy as amended by the Store. The Store is not responsible for any Losses (if any) suffered by the User due to changes in the Policy.

Article 3 - Eligibility of Use of the Service

  1. Users must use the Service in accordance with the terms set out by the Store in this Policy, or the policies set out separately.
  2. Applicants must comply with the general criteria, and requests by the Store. The Applicant must provide the Store with information and documents that the Applicant meets the criteria:
    1. The applicant must fulfill the information request and/or registration form required by the Store on the Site;
    2. The applicant must have the legal capacity to enter into an agreement;
    3. The Applicant must confirm that the application is made in his own name and that the Account, upon activation will be used by the Applicant for his own account and not as an agent of any third party;
    4. The applicant must meet the criteria and procedures as may be determined by the Store from time to time in accordance with the Store's internal policies or as required by Applicable Law.
  3. The Store has sole and absolute discretion to determine an Applicant's eligibility for membership registration for the Service. The Store, however, is not required to give any reason to the Applicant in refusing the Petitioner's application.

Article 4 - Termination of Service and Deletion of Membership Registration

  1. The Store may suspend the provision of the Service, delete the Account and take other legal steps required by the Store without prior notification to the User, if the User does any of the following:
    1. Users are found to have violated the applicable Policy;
    2. Delay in paying the Service fee or failure to meet other requirements required by the Store;
    3. The user performs the actions as regulated in Article 41;
  2. In the event of a Loss to the Store or a third party due to a violation of the Policy by the User, the User must reimburse all costs for the Loss suffered by the Store or the third party. And for any complaints, questions or claims submitted by third parties as a result of such violations, the User must resolve them at his own responsibility and expense without causing difficulties for the Store.

Article 5 - Content of Publication

  1. The Store ensures not to contain information that is prohibited under Applicable Law. However, the User must evaluate and assume all risks related to Service information, in particular for information provided by third parties, including, but not limited to, confidence in the completeness and accuracy of the information contained.
  2. The Store reserves the right to change and delete any information on the Site according to the Store's needs.

CHAPTER 2 - CUSTOMERS

Article 6 - Registration

  1. Everyone who wants to register for membership must comply with the procedures on the Site as required by the Store.
  2. Membership registration is considered completed when the Store approves the registration referred to in paragraph (1). However, in the following cases, the Store is obliged to refuse registration or cancel the registration after it is found by the Store that:
    1. the applicant makes an inaccurate statement;
    2. Other matters determined by the Store that the Applicant is not entitled to obtain his/her membership status.

Article 7 - Management and Responsibilities of Email Addresses & Passwords

  1. Users must register an e-mail address and password to obtain membership status on the Site. Users may not transfer, lend or sell email addresses and passwords or use them as collateral to third parties.
  2. The registered email address and password may be used in all parts of the Site.
  3. The user is the sole party responsible for the use and management of his e-mail address and password, and must be responsible for all things done on the Site, even if such action is not taken by him.
  4. The Store is not responsible for User Loss resulting from the use of e-mail addresses and passwords by third parties, whether intentional or unintentional or is the fault of the User.

Article 8 - Termination of Membership

  1. If the User performs any of the prohibited acts as regulated in Article 41 (prohibited actions), the Store may suspend the provision of the Service without prior notification or warning to the User or permanently disable its membership.
  2. The User must indemnify the Store if the User takes the actions as regulated in paragraph (1), and the User must also bear the Loss if the Store carries out legal proceedings related to this matter.
  3. The User must notify the Store if the User cancels membership for his own reasons by contacting the Store via email to Asisama Supportwith the aim of deactivating the account.

CHAPTER 3 - RATINGS & REVIEWS

  1. Rating (Rating)is defined as a feature of the rating level given by the User on the products displayed by the Store on the Site. Reviews (Reviews) are defined as a feature of reviews provided by Users on products displayed by the Store on the Site.
  2. Users can use the Rating & Review service on the Store Site.

Article 9 - Use of Content Reviews

  1. Companies may use Reviews without prior notice to contributing Users. The User agrees that the Store may also use the Reviews in reproduction, quotation, disclosure, offer, publication, onlinedistribution and other forms without having to pay any fees to the User. The User further agrees that he does not have any rights to his Reviews to the Store and the parties appointed by the Store.
  2. Users are not allowed to reproduce, modify, edit or copy the content of Reviews contributed by other people or other Users unless otherwise determined by the Store.
  3. The User agrees that the viewing and retention period of the Reviews is determined solely by the Store at its discretion.

Article 10 - Limitation of Review Contribution and User Liability

  1. Users are prohibited from providing Reviews that contain the following elements:
    1. Defamation of the Store or third parties;
    2. Associated with crime or encouraging crime;
    3. Violating Applicable Laws;
    4. Generate publicity for profit purposes;
    5. Make certain political and religious claims;
    6. Harm the Store's reputation without foundation or may increase credit problems;
    7. Violate or may violate Intellectual Property Rights, credit, privacy and other rights of the Store or third parties;
    8. Disclosing discrimination;
    9. Elements of vulgarity, harm, violence and threats, violence, or intimidation to others;
    10. Contrary to public order or generally accepted social norms;
    11. Contains personal information, such as name, telephone number, email address, home address, workplace, credit card number and bank account number;
    12. Contains malicious programs or scripts, such as viruses and others;
    13. Other matters deemed inappropriate by the Store.
  2. If a violation of the provisions referred to in paragraph (1) is found, the Store may take the following steps:
    1. Elimination of Ratings and Reviews that violate the provisions in the previous paragraph;
    2. Suspend the use of Ratings and Reviews for infringing Users.
    3. Other steps deemed necessary by the Store.
  3. Users who provide Reviews as provided for in paragraph (1) will indemnify all Losses to the Store or related third parties due to such violations.
  4. Users are solely responsible for questions, complaints and requests from third parties related to User Reviews that violate the Policy and their rights.
  5. In the event that a third party makes a claim on the Reviews provided by the User due to the disclosure of information that violates the privacy of the third party, or a claim arises regarding the disclosure of information as regulated by Applicable Law, the Store may disclose the User's Personal Data in accordance with Applicable Law.

Article 11 - Exemption Clause

  1. The Content of the Review shall be based on the User's responsibility. The Store does not guarantee the correctness, accuracy, reliability and completeness of Reviews by Users on the Site.
  2. The Store is under no obligation to monitor the contribution of Review content to comply with the Policy.
  3. Users are fully aware that temporary or permanent termination of the Service may occur due to unavoidable circumstances such as maintenance of Store systems or damage to communication lines, and other related matters. In this case, the User agrees not to claim compensation of any kind to the Store.
  4. The Store is not responsible for the loss of User information in connection with the Service.

CHAPTER 4 - PROMOTION

Article 12 - Promotional Coupon

  1. The Site provides promotional programs which can be in the form of vouchers/coupons and prizes (hereinafter collectively referred to as “Promotions”) for Users with certain conditions. Promotion is defined as the User's right to enjoy discounts or gifts from the Store.
  2. The Store may provide vouchers/coupons as regulated in paragraph (1) to Users, in accordance with the conditions and procedures determined by the Store separately.
  3. The User agrees that the Store may modify the existence, conditions and procedures for giving vouchers/coupons at any time without prior notification to the User in accordance with Applicable Laws.
  4. In terms of obtaining and using vouchers/coupons, Users must comply with Store Policy.

Article 13 - Prohibition of Accumulation/Registration of Vouchers/Coupons and Registration of Multiple Accounts

  1. If the User has several vouchers/coupons, the User is prohibited from accumulating the vouchers/coupons he has.
  2. The User agrees that the Store has the right to cancel the giving of the voucher/coupon if the User takes any action that is suspected to be detrimental to the Store, including creating a fake account to get a voucher/coupon and other detrimental actions.

Article 14 - Cancellation

  1. The Store may cancel vouchers/coupons and gifts given to Users for appropriate reasons according to the Store's sole judgment such as cancellation of products from suppliers, and others without prior notification to Users.
  2. The Store may cancel the coupon without prior notification to the User as regulated in paragraph (1) if the Store considers that the User is suspected of and/or involved in one of the following:
    1. Illegal acts or dishonest acts;
    2. A violation of the Policy;
    3. Other matters deemed by the Store to be appropriate for the cancellation of giving vouchers/coupons to Users.
    4. Coupon validity has expired.
    5. The Store is not obliged to reimburse if the coupon is canceled or expired.

Article 15 - Settlement of Disputes on the Use of Vouchers/Coupons

  1. Users can pay for orders either in part or in full with vouchers/coupons whose discount rate and amount are determined by the Store for payment on the Site in accordance with conditions determined by the Store.
  2. The Store may add provisions regarding the use of vouchers/coupons mentioned in paragraph (1) without prior notification to the User.
  3. If the User cancels the order, the Store will not replace the voucher/coupon or replace it in cash value with the amount related to the cancellation of the order.
  4. If the User uses a voucher/coupon for payment and the amount to be paid is lower than the nominal amount of the voucher/coupon, the Store will not refund the difference in the value of the goods purchased with the voucher/coupon or cash.
  5. If the User uses a voucher/coupon for payment and for some reason the bill (amount to be paid) changes to a higher one, then the User must pay the shortfall in another form of payment with the conditions set by the Store.

Article 16 - Cancellation After Using Voucher/Coupon

If the voucher/coupon is canceled as referred to in Article 14 after the User uses the voucher/coupon for the completion of the purchase, the product order may be canceled and will be held by the Store. If the User wants to continue to get the product, the User must pay in cash or other payment methods determined by the Store.

Article 17 - No Money Conversion and Promotional Sale and Purchase

  1. User may not convert Promotion into money for any reason.
  2. Users who are entitled to the Promotion are not allowed to trade Promotions that have been determined by the Store for Users who are not entitled according to the decisions of the Store.

Article 18 - Use of Promotions by Third Parties

  1. Use of the Promotion will be carried out by the authorized User and not for a third party or other person, unless otherwise specified by the Store as regulated in the given Promotion.
  2. The user who uses the Promotion is the person/party who has the right to use it. If the Promotion is used by another party, then the Store will not replace the Promotion or be responsible for any User Loss

Article 19 - Taxes and Fees

Any unexpected taxes or fees incurred while using the Service shall be borne by the User.

Article 20 - Loss of Membership Status

If the User loses his membership status, the User will lose all Promotional rights he has. With the loss of membership status, the User also loses his rights to the Store.

Article 21 - Promo Change

  1. The user agrees that the Store may delete the Promotion, suspend the giving of vouchers/coupons and modify the contents of the Promotional Services such as changes, subject and amount of discounts, validity period, etc. at any time.
  2. The Store is not responsible for anything in case of Loss or damage to the User due to the changes mentioned in paragraph (1).

CHAPTER 5 - PURCHASE

Article 22 - Price Offer

  1. The Store provides Services to provide price quotes, either onlinethrough the Site, which are carried out independently by Users, or offline requests that will be processed by the Store.
  2. Offlinequote requests are only valid for Users who already have an account on the Site with a Business Account type.
  3. Offlineprice quotes require processing time with the Store's Policy.
  4. The user agrees that the Store has the right to refuse to provide a price quote if there is a discrepancy with the Store's policies.

Article 23 - Product Purchase

  1. Users have the right to purchase products through the Site.
  2. Users will get an order number which will be the identification of orders that have been placed after each order.

Article 24 - Acceptance of Orders

After the User places an order on the Site, the Store's system will send an email to the User to confirm receipt of the order and provide information on the order completion mechanism. At that time, it is deemed that the sales contract regarding the product in question between the User and the Store is valid.

Article 25 - Transfer of Ownership

Regardless of the payment method and form of delivery, ownership of all purchased products will be transferred to the User when the User receives the product.

Article 26 - Cancellation

  1. If any of the following occurs, the Store may cancel or stop the process of selling orders from Users without prior notice:
    1. User violates the Policy;
    2. There has been a notification of a rejected payment from the debit card or credit card used by the User;
    3. The product cannot be delivered due to an incorrect or inaccessible address or the absence of the relevant User;
    4. False information data is found in the Personal Data provided by the relevant User;
  2. In addition to the provisions stated in the previous paragraph, the Store may cancel or stop the sale and take appropriate steps if there is a dishonest or inappropriate action regarding the use of the Service and the Site by the User.
  3. In the case of paragraphs (1) and (2), the Store may claim Losses arising from the cancellation caused by the User. However, the User concerned cannot claim a loss to the Store if the User suffers a loss as a result of the cancellation.
  4. Users can cancel or stop the purchase of an order by using the features provided on the Site.

CHAPTER 6 - PAYMENT

Article 27 - Scope of Payment

  1. User must pay all order fees including value added tax, shipping and handling, as well as other fees determined by the Store.
  2. The Store can accept this type of payment by bank account transfer and in Rupiah.
  3. The Store considers the payment to be fully paid by the User after the money is received in the Store's bank account.

Article 28 - Payment Method

  1. Several payment methods provided by the Store on the Site can be selected by the User when placing an order by complying with the conditions of each payment method.
  2. The Store cooperates with third parties in the 'Payment Gateway'for several types of payment methods available.
  3. Payment by debit card or credit card must be in accordance with the contract agreed between the User and the debit or credit card issuing Store. The Store is not responsible for conflicts that may occur between the User and the debit or credit card issuing Store.

CHAPTER 7 - TAX BILLS & INVOICES

Article 29 - Provisions for Tax Bills & Invoices

  1. The Store may issue invoices and tax invoices for orders placed by Users as a representative of a Store.
  2. The Store will send invoices and tax invoices, either in the form of soft copiesor printed sheets if requested by the User, in accordance with the applicable regulations in the Store.
  3. In the event of a request for a tax invoice, the User must provide the Store with the following information:
    1. Store name;
    2. Address and telephone number;
    3. TIN number;
    4. NPWP registered address.
  4. The content and time of issuance and/or delivery of invoices and tax invoices follow the rules determined by the Store, and the User must comply with the rules listed but not limited to the Site.
  5. Users are allowed to submit changes to billing information and/or tax invoices to the Store if there is a difference in information that does not match the related documents issued by the User. However, the submission is entirely the Store's policy and must follow the rules listed but not limited to the Site.

CHAPTER 8 - RETURNS & REFUNDS

Article 30 - Return of Goods

  1. The user has the right to submit a request for a return of goods if it is found that the condition of the product received is as follows:
    1. production defects;
    2. Does not function properly ( malfunction);
    3. Does not match the information provided on the Site;
    4. There are parts that are incomplete;
    5. Damaged at the time of delivery;
    6. Wrong delivery of goods, both type and quantity.
  2. In terms of the policy of returning goods, the Store determines the following things that must be met by the User in order to be able to process the return application:
    • . The validity period of submissions that can be accepted by the Store is from the time the goods are received by the User until the time limit informed on the Site;
  1. The user can include parts of the goods to be returned which form an integral part of the goods being sold;
  2. The user provides actual information regarding the condition of the goods he receives and is evidenced by photo attachments to support his statement;
  3. Users are willing to wait for the validation process carried out by the Store;
  4. The user is subject to the results of the decision or solution provided by the Store on the request for return of the goods submitted.

Article 31 - Refund

  1. The Store will return funds to the User in the event of an order cancellation, return of goods, overpayment, or other matters that can cancel the purchase and payment process that does not harm the Store with the refund process.
  2. The Store determines the refund period according to the Store's ability, as well as the policy of each bank appointed by the User to receive a refund until the User can reuse the funds.
  3. Refunds will be made through a bank transfer process or refund of the limit balance to the User's credit card used to pay for the related goods.
  4. For the refund process via bank transfer, the Store requires the User's designated bank account information which includes:
    1. Bank name;
    2. City and Bank Branch;
    3. Account number;
    4. Name of Account Owner (must match the name listed in the savings book/current account)
  5. The Store is not obliged to check the correctness of the account submitted by the User for the refund process, and the account information will be deemed correct and submitted by email to the Store by the authorized User in accordance with the registered account.
  6. The Store is not responsible for any legal consequences and losses arising from the delivery of customer information and/or misuse of the account holder's number and name for the refund process.
  7. The Store has the right to request proof of transfer of payment transactions made by the User for the Store's internal needs, both before and after the Store processes the refund.
  8. The Store will send information via email that the refund process has been completed by the Store.

CHAPTER 9 - PRODUCTS & PRICES

Article 32 - Procurement of Goods

  1. Provisions regarding the provision of goods to be sold are determined entirely by the Store.
  2. The Store provides goods legally, both obtained from local sources and imported from abroad.
  3. In the process of providing goods until the goods are ready to be shipped (hereinafter referred to as the “Goods Preparation Period”), the Store takes various times during which the information is displayed on the Site and/or directly informed by the Store to the User.
  4. The Store reserves the right to change the Goods Preparation Period at any time in accordance with the Store's interests without prior notification to the User.
  5. The user understands that there may be delays in the Goods Preparation Period for the supply of the ordered goods to the Store. In that case, the User acknowledges that the Store is not responsible for the User's Losses as a result of delays in the Preparation Period of the Goods ordered by the User.

Article 33 - Product Information

  1. Users have the right to correct, clear, and honest information regarding the conditions and guarantees of goods. However, the User agrees that the Store is not responsible for any warranties that the description is accurate, current or error-free.
  2. The Store will communicate with suppliers if there is information, description, price or product images that are inaccurate based on complaints or reports from Users.
  3. All objections from the User on the difference between the goods received and the product information submitted through the Site will follow the provisions of Article 30 regarding Return of Goods.

Article 34 - Price

  1. The price to be paid by the User is the price displayed when the User confirms the order payment on the Site.
  2. All prices of goods listed on the Site include VAT, except for Non-Taxable Goods (BTKP) in accordance with tax provisions in Indonesia.
  3. The Store reserves the right to change product prices on the Site at any time without giving any reason or prior notice.
  4. If there is a typo in the price of goods on the Service that is not accidental which is not the fault of the Store, the Store has the right to refuse orders made by the User at the wrong price.
  5. The user agrees to pay the total cost to be paid, which consists of the price of goods, shipping costs, handling fees and other costs that may arise and will be clearly described in Article 27 regarding Payment Scope.

CHAPTER 10 - DELIVERY & DELIVERY

Article 35 - Terms of Delivery

  1. In addition to using the Store's delivery service known as Asisama Express, the Store also cooperates with third parties in the delivery service appointed by the Store.
  2. The Store has full authority for the matters mentioned below and the User is subject to the conditions determined by the Store:
    1. Determine the operational working hours of the Store's logistics team;
    2. Designate the delivery service to be used for each User, product or delivery area;
    3. Arrange order delivery schedule in accordance with the interests of the Store.
  3. Taking into account the ability of the shipping service Store, the Store has the authority to determine the period of delivery of goods to each destination delivery area as displayed on the Site.
  4. The delivery period of the goods listed on the Site is approximate and the Store reserves the right to change it at any time without prior notice.
  5. The Store does not guarantee that each period of delivery of the goods will not be delayed for any reason, and the Store is not responsible if the user suffers losses as a result of the delay.
  6. The estimated delivery period listed on the Site is calculated from the time the goods are ready to be sent by the logistics team, and this period does not include the procurement period.
  7. Delivery of certain types of goods, such as liquids, gases and combustible materials or other types of goods that can be determined later, may take longer than what has been delivered on the Site due to differences in shipping handling.
  8. Delivery to some areas that are difficult to reach such as isolated islands or remote places, or other possible reasons may take longer than what has been delivered on the Site or even rejection of the delivery process to these areas.

CHAPTER 11 - PRIVACY & PERSONAL DATA PROTECTION

Article 36 - Use of Personal Data

  1. With the consent of the User, the Store may obtain, use, disclose all or part of the Personal Data obtained and collected from the User as referred to in the previous section for the following purposes:

a. Process all forms of requests, activities and transactions made by Users through the Site, including for the purpose of sending products to Users.

b. Provide features to deliver, deliver, maintain and improve the Store's products and services, including:

I. Offer, obtain, provide, or facilitate E-commerce services , insurance, financing, loans and other products through the Site;

II. Allows features to personalize User accounts, such as Wishlist; and/or

III. Perform internal activities necessary to provide Services on the Site such as troubleshooting software problems , bugs , operational issues, data analysis, testing and research, and to monitor and analyze usage trends and activities.

c. Assist Users in communicating with the Store's customer service, including to:

I. Checking and solving User problems in using the Service;

II. Direct User inquiries to appropriate customer service personnel to resolve issues; and

III. Monitor and improve the Store's customer service response.

d. Contacting Users via email, letter, telephone, facsimile, or other means deemed reasonable by the Store, including but not limited to assisting and/or completing the transaction process or problem solving process.

e. Using information obtained from Users for the purpose of research, analysis, product development and testing in order to improve the security and convenience of services on the Site, as well as develop new features and products.

f. Inform Users regarding products, services, promotions, studies, surveys, news, latest developments, events and other matters related to the Service, either through the Site or through other media. The Store may also use this information to promote and process contests and sweepstakes, award prizes, and serve advertisements and relevant Content about the Site's services and business partners.

g. Monitor or investigate suspicious transactions or transactions that are indicated to contain elements of fraud or violations of the Terms and Conditions or applicable legal provisions, and take necessary actions as a follow-up as a result of monitoring or investigating these transactions.

  1. The Site uses the 'Cookies'function (trace or history of pages visited) and other tracking technologies to better Service in accordance with its terms. By using the Site, the Applicant/User agrees to use our Cookies function . The Applicant/User can set the browser by changing its settings/options, to stop accepting cookies or asking the User before accepting cookies from the website that the Applicant/User visits, in accordance with the instructions provided by the browser used by the Applicant/User.
  2. The Store will use the Personal Data for a limited period of time and will deactivate the User's Personal Data without delay if the User requests termination of his membership, or his consent in accordance with Applicable Laws.

Article 37 - Protection of Personal Data

  1. The Store collects, processes, and uses the Applicant/User's Personal Data only in the scope necessary and in a lawful and appropriate manner.
  2. The Store will take technological, administrative and physical measures to ensure the Personal Data of the Applicant/User is not lost, misused, accessed and disclosed illegally, falsified, or tampered with.
  3. The Store does not sell, lend, transfer and disclose personal information to third parties without the consent of the Applicant/User except for the following:
    1. Comply with legal requirements or decisions of administrative authorities or judicial bodies;
    2. User violations related to Indonesian laws or policies;
    3. Other matters at the Store's discretion in accordance with Applicable Laws or Site usage policies.
  4. If there is a failure in the protection of Personal Data as regulated in this Article, the Store must provide written notification to the owner of the Personal Data.

CHAPTER 12 - OTHER PROVISIONS

Article 38 - Prohibition of Transfers

Users will not transfer, lend or sell their rights from the Service to third parties.

Article 39 - Compensation

The Store is not responsible or liable to compensate for User or third party Losses related to delay in use, suspension of modification, or deletion of disclosure of the Service or loss of information provided.

Article 40 - Intellectual Property Rights

Users are not permitted to copy the Intellectual Property Rights of the Service. All Intellectual Property Rights of the service pages and images are strictly owned by the Store, and therefore it is prohibited to duplicate, distribute, transfer, lend, translate, use, reproduce, exploit or reuse the Content in accordance with Applicable Laws.

Article 41 - Prohibited Things

Users are prohibited from performing the following actions in the use of the Service:

  1. Interfere with the operation of the Service and hinder the Service;
  2. Unauthorized use of a debit or credit card;
  3. Behavior that causes or may cause damage or loss to the Store or third parties;
  4. Violation of Intellectual Property Rights, privacy or other rights of the Store or third parties;
  5. Behavior that disrupts public conventions and social order;
  6. Criminal acts or related behavior;
  7. Inaccurate statements or submissions in registration such as e-mail addresses or other relevant information;
  8. Business activities for profit purposes;
  9. Damage the goodwill and credibility of the Store;
  10. Use or provide malicious programs such as computer viruses or hacking activities and behaviors that could result in such situations;
  11. Steal email addresses and passwords from other members;
  12. Not paying bills and / or delaying payments for products purchased through the Service;
  13. Violation of Policy;
  14. Violation of Applicable Laws, both domestic and international;
  15. Use of the Service in a manner not recommended by the Store;
  16. Connect the Service to other databases without the consent of the Store;
  17. Illegal and corrupt access to data on the Service's computer servers;
  18. Other actions deemed inappropriate by the Store.

Article 42 - Changes to Temporary Suspension and Termination of Service

  1. The Store may change the contents of the Service without prior notice to the User.
  2. The Store may suspend part or all of the Services at its sole discretion without prior notice to the User in the following cases:
    1. Routine or urgent maintenance or device and system updates for the Service;
    2. Failure to provide Services due to Force Majeure, which means any circumstances beyond the reasonable control of the Store that make it impossible or impede the Store's performance of the Policy such as;

I. War, riots, civil unrest or revolution, sabotage, terrorism, rebellion, acts of civil or military authority, imposition of sanctions, embargoes, severance of diplomatic relations or similar situations;

II. Terrorist attacks, civil wars, civil commotions or riots;

III. God's actions, epidemics, pandemics, earthquakes, hurricanes or other natural disasters or adverse weather or environmental conditions;

IV. Any state action or action to enforce sovereignty, judicial or executive prerogatives by a government or public authority, including, expropriation, nationalization or compulsory acquisition or justifiable actions for executive purposes;

V. Fire, explosion or accident causing damage;

VI. Destruction of building structures or failure of factory machinery, computers or vehicles;

VII. Interruption or failure of utility services, including but not limited to electric, gas or water power; or

VIII. Any labor disputes, including but not limited to strikes, industrial actions and work bans.

          1. Other circumstances as decided by the Store are necessary to temporarily suspend the Service, such as operational or technical reasons or service failure due to unforeseen circumstances.
  1. The Store must notify on the main page of the Site of the situations mentioned in clauses (1) and (2) above.
  2. The Store is not responsible if the User is unable to use the Service and suffers Loss due to the situations mentioned in this Article.

Article 43 - Limitation of Liability

  1. The Store is not responsible for external websites linked to the Service by third parties. The Store is not responsible for compensating for any damage caused by or related to the relevant services on external sites.
  2. In the event that a product is found to have quality problems upon arrival, the Store's liability is limited to the price of the product concerned. The Store is not responsible for indirect damage due to problems with the product in question.
  3. The Store is not responsible for products that are damaged due to misuse by users.
  4. The product display may differ from the actual image due to the settings of the screen or monitor, etc.
  5. If the User causes damage or loss to another User or a third party, the User concerned must resolve the Loss himself and at his own expense and the Store is not responsible.
  6. If the Store is to provide notice to Users, the Store must fulfill its responsibilities by sending the notification to the previously registered email address and sending the purchased product at the address addressed to the member.
  7. If there is a delay or failed delivery caused by the User's error due to not following the procedure, the Store is not responsible for the Loss experienced by the User. And if the delay or failure in product delivery is due to Force Majeure as described in Article 42 paragraph (2), the Store is not responsible for the losses suffered by the User.
  8. The Store is not responsible other than as provided in the Policy for damages and Losses related to the use of the services and products sold through the Service, regardless of the legal cause of the claim.
  9. The Store is not responsible for any losses suffered due to the fact that the User cannot use the Service for his own reasons.

Article 44 - Internet Fee

  1. The User must bear the costs of setting up computers and communication equipment, telephone costs or internet/LAN fees required for the use of the Service by the User.
  2. Under the Policy, the User must bear any public costs such as consumption tax levied on fees for the use of the Service.

Article 45 - Law and Jurisdiction

Everything that is not regulated in the Policy for the Store's products and services will be governed by Applicable Law in Indonesia. And in the event of a dispute between the User and the Store, the District Court where the Store is registered will have exclusive jurisdiction.
